Terms and Conditions

Welcome to Music Traveler. These Terms and Conditions ("Terms") are a binding agreement between you and Music Traveler GmbH, Annagasse 1/10, 1010 Vienna, Austria ("Music Traveler", "we", "us", or "our").

Music Traveler operates an online platform (the "Platform") that connects Hosts — who offer premises, rooms, or spaces ("Music Spaces") and/or musical instruments and equipment ("Music Instruments" / "Music Equipment") — with Users who book them for music practice, performance, events, and similar uses (the "Services").

By accessing or using the Platform, you agree to these Terms and to our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not use the Platform.

Important Notice — Music Traveler is a Marketplace Only >Music Traveler operates a technology platform that connects independent Hosts with Users. Music Traveler is not a party to any agreement between a Host and a User, is not a real-estate broker, agent, or insurer, and does not own, control, manage, or insure any Music Space, Instrument, or Equipment. All bookings are made directly between the Host and the User. Hosts are solely responsible for the legality, safety, condition, insurance, permits, and taxes applicable to their listings. Users book and use listings entirely at their own risk. >- Hosts are responsible for understanding and complying with the laws, permits, licences, and taxes that apply to listing their Music Space, Instruments, or Equipment.- Hosts must carry their own appropriate insurance (e.g. property and public-liability cover) for their Music Spaces, Instruments, and Equipment. Music Traveler does not provide, sell, arrange, or intermediate insurance of any kind and is not an insurer.- Users are responsible for any damage they (or their guests) cause and are encouraged to hold suitable liability cover.

1. The Host–User relationship

The Platform is a venue through which Hosts create listings and Users book them directly with the Host. Music Traveler is not a party to the agreement between a Host and a User, and is not a real-estate broker, agent, or insurer. We do not own, control, or manage any Music Space, Instrument, or Equipment; we do not set listing prices, house rules, or availability; and we disclaim liability for the acts, omissions, and conduct of Hosts and Users to the maximum extent permitted by law.

2. Independent parties

Your relationship with Music Traveler is solely as a User or Host. You are not our employee, agent, partner, or joint venturer, and you must not imply otherwise or misuse our brand or intellectual property.

3. Eligibility

The Platform is intended for persons aged 18 or older. By using the Platform you confirm you are at least 18. (Separate age rules apply to Music Traveler Live events — see the final section.) If you accept these Terms on behalf of an organisation, you confirm you are authorised to bind it.

4. Assumption of risk and release of liability

You acknowledge and agree that:

  • Use of the Platform and participation in any Booking involves inherent risks, including but not limited to risks associated with music practice, performance, equipment, spaces, premises, other people, and travel.
  • You voluntarily assume all risks associated with your use of the Platform, any Booking, and any Music Space, Instrument, or Equipment, whether those risks are known or unknown.
  • To the maximum extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Music Traveler GmbH and its officers, directors, employees, agents, affiliates, and partners from any and all claims, demands, damages, actions, or causes of action arising out of or related to any Booking, the condition or use of any listing, any act or omission of any Host or User, or any other matter related to the Services.

Nothing in this Section excludes or limits any liability that cannot be excluded or limited under mandatory applicable law, including liability for death or personal injury caused by gross negligence or wilful misconduct, and the mandatory consumer-protection rights of consumers in their country of residence.

5. User and Host vetting

To the extent permitted by law, we may (but are not obliged to) perform identity, background, or sanctions checks on Users or Hosts and may request supporting documents. We make no warranty that any check will identify past or prevent future misconduct, and we disclaim related warranties to the extent permitted by law.

6. Accounts

To use the Platform you must register and provide accurate, complete, and current information, including a valid phone number and payment method. You are responsible for keeping your credentials secure and for all activity under your account, including activity by anyone you bring into a Music Space following a booking. Payment details are processed by our payment processor, Stripe, under its own terms and privacy policy.

You agree to comply with any additional house rules, building security, or venue policies provided by a Host ("Venue Policies").

7. Bookings, fees, and payments

A "Booking" is a limited licence granted by the Host to the User to enter and use the listed Music Space and/or Instruments and/or Equipment for the confirmed time.

Pricing. Each listing's price is set by the Host and may include a base rate (per hour or per day), optional add-ons, a cleaning fee, an extra-guest fee, and a refundable security deposit, as shown at checkout.

Music Traveler service fee. Music Traveler charges a service fee, calculated as a percentage of the booking subtotal (and, where applicable, a small fixed amount), disclosed to you before you confirm. We use a destination-charge model via Stripe: the User pays the total at checkout, Music Traveler retains its service fee, and the remainder is paid out to the Host. Stripe processing fees apply as part of payment handling. We may change our fees prospectively; changes do not affect Bookings already confirmed.

Currency and taxes. Prices may be shown in your local currency for convenience using indicative exchange rates; the charge currency is shown at checkout. Hosts are responsible for any VAT and taxes applicable to their listings and payouts.

Cancellations and refunds. Refunds are governed by the cancellation policy shown on the listing at the time of Booking and by applicable consumer law. Where you are entitled to a refund (for example, under the listing's cancellation policy, where a Host cancels, or where mandatory consumer-protection law applies), we will process it to your original payment method. Service fees may be non-refundable where permitted by the applicable cancellation policy and law.

Overstays. If you use a Music Space beyond your booked time, you may be charged for the additional time and any resulting conflict with another Booking, and a security deposit may be applied to such amounts.

8. Damage, security deposits, and claims

As a User, you must leave the Music Space, Instruments, and Equipment in the condition you found them, and you are responsible for the acts and omissions of anyone you bring.

  • Security deposits. Hosts may require a refundable security deposit, shown on the listing. Deposits are released after the Booking absent a valid claim.
  • Damage claims. If a Host reports damage with supporting evidence, we will notify you and give you an opportunity to respond. Where you agree, or where we reasonably determine you are responsible, you agree to pay the reasonable cost of repair or replacement, which may be collected from your payment method and/or the security deposit.
  • Role of Music Traveler. We may help facilitate communication between Hosts and Users about damage claims, but we are not an insurer, do not guarantee any outcome, and disclaim liability for administering claims to the extent permitted by law. Hosts are expected to rely on their own insurance for losses not recovered from a User.

Both parties agree to cooperate reasonably and in good faith in resolving claims.

9. Insurance

Music Traveler does not provide, sell, arrange, or intermediate insurance of any kind, and is not an insurer. No part of any price charged on the Platform is an insurance premium, and no booking includes cover provided by Music Traveler.

  • Hosts are solely responsible for obtaining and maintaining appropriate insurance for their Music Spaces, Instruments, and Equipment, including property and public-liability cover, and for any liability arising from hosting.
  • Users are responsible for any damage they or their guests cause and are encouraged to hold suitable liability cover.
  • Any reference, on the Platform or in older materials, to a "Music Traveler Insurance Policy" or to coverage provided by Music Traveler no longer applies and is superseded by these Terms.
  • If Music Traveler ever makes an optional third-party insurance product available, that cover would be provided directly by a licensed third-party insurer under its own terms, and Music Traveler would not be the insurer or a party to any resulting insurance contract or claim.

10. Acceptable use

You agree not to:

  • violate any law, regulation, zoning rule, or tax obligation;
  • scrape, crawl, or use bots to access the Platform other than as expressly permitted;
  • use the Platform to mislead others about your affiliation with Music Traveler, or to harm our brand;
  • infringe the intellectual property, privacy, or other rights of any person;
  • interfere with or attack the Platform (malware, DoS, spoofing, etc.);
  • harass, stalk, or collect personal data about other Users or Hosts beyond what a transaction requires;
  • list any Music Space, Instrument, or Equipment you do not own or have permission to offer; or
  • contact another User or Host for purposes unrelated to a Booking or listing.

11. Intellectual property

Music Traveler owns all rights in the Platform, its software, design, and brand. By submitting content (e.g. listing photos, descriptions, reviews, messages), you grant Music Traveler a non-exclusive, worldwide, royalty-free licence to host, display, and use that content solely to operate, promote, and improve the Services. You retain ownership of your content and are responsible for having the rights to submit it. We respect copyright and will remove infringing content and may terminate repeat infringers.

12. User representations

You represent that: (a) you have the legal capacity to enter these Terms; (b) you meet the minimum age; (c) the information you provide is accurate; (d) you will not infringe others' rights; (e) you will comply with applicable laws and any required licences; and (f) you will obtain any insurance required for your use.

13. Disclaimers — no warranty ("as is")

The Platform and Services are provided "as is" and "as available", without warranties or representations of any kind, whether express, implied, or statutory, to the maximum extent permitted by law, including any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, and we do not warrant the quality, safety, legality, suitability, or accuracy of any listing, Music Space, Instrument, Equipment, Host, or User. You interact with Hosts and other Users at your own risk and should take reasonable precautions.

14. Limitation of liability

To the maximum extent permitted by applicable law:

  • Music Traveler shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses, whether based in contract, tort (including negligence), statute, or otherwise, arising out of or in connection with the Platform, any Booking, or these Terms.
  • Music Traveler's total aggregate liability to you for all claims arising out of or relating to the Platform or these Terms shall not exceed the greater of (a) the total amount of fees actually paid by you to Music Traveler (or received by you from Music Traveler, if you are a Host) in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) EUR 100.
  • These limitations apply even if Music Traveler has been advised of the possibility of such damages and even if any limited remedy fails of its essential purpose.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under mandatory applicable law, including (i) liability for death or personal injury caused by gross negligence or wilful misconduct, (ii) liability for fraud, and (iii) the mandatory consumer-protection rights of consumers in their country of residence.

15. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Music Traveler GmbH and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • your breach of these Terms or any applicable law;
  • your use of the Platform or any Booking;
  • any content you submit;
  • any damage to a Music Space, Instrument, or Equipment caused by you or your guests;
  • any dispute between you and another User or Host; or
  • any claim by a third party arising from your acts or omissions.

This indemnification survives termination of these Terms and your use of the Platform and does not apply to the extent prohibited by mandatory consumer law or to the extent the relevant loss was caused by Music Traveler.

16. Platform decisions and enforcement

Music Traveler has sole discretion over content moderation, the approval, ranking, and removal of listings, account suspension or termination, and the enforcement of these Terms. To the maximum extent permitted by law, we are not liable for any such decisions or for any resulting unavailability of the Platform, a listing, or an account.

17. Third-party acts and services

The Platform may rely on or link to third parties, including Hosts, Users, payment processors, map and communication providers, and other service providers. To the maximum extent permitted by law, Music Traveler is not responsible or liable for the acts, omissions, products, services, content, or terms of any third party, and your dealings with any third party are solely between you and that third party.

18. Force majeure

Music Traveler is not liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, strikes, failures of telecommunications or internet services, power outages, governmental actions, or third-party service failures.

19. Suspension and termination

We may suspend or terminate your access if you breach these Terms or applicable law, or where reasonably necessary to protect the Platform, Hosts, or Users. You may close your account at any time at Settings. On termination, your licence to use the Platform ends.

20. Survival

The provisions of these Terms that by their nature should survive termination will survive, including (without limitation) the sections on assumption of risk and release, damage and claims, insurance, intellectual property, disclaimers, limitation of liability, indemnification, platform decisions, third-party acts, governing law and disputes, and these general provisions, together with any accrued payment obligations.

21. Governing law and disputes

These Terms are governed by the laws of the Republic of Austria, excluding its conflict-of-laws rules and (where applicable) the UN Convention on Contracts for the International Sale of Goods.

  • Consumers: if you use the Platform as a consumer, you benefit from the mandatory consumer-protection laws of your country of residence, and you may bring proceedings in the courts of your place of residence. Nothing here deprives you of those protections. The EU Online Dispute Resolution information and your national consumer ADR bodies remain available to you; we are willing to engage in good-faith resolution before any formal proceedings.
  • Businesses (non-consumers): the courts of Vienna, Austria have exclusive jurisdiction.

We encourage you to contact us first at legal@musictraveler.com so we can try to resolve any dispute informally.

22. General

We may modify these Terms; we will update the "Last updated" date and, for material changes, provide reasonable notice. If any provision is unenforceable, the rest remain in effect, and the unenforceable provision will be applied to the maximum extent permitted by law. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a corporate transaction. These Terms are the entire agreement between you and us regarding the Platform.

Music Traveler Live — Event Terms

These additional terms apply to participants (ticket holders, performers, and attendees) of events organised or co-organised by Music Traveler Live (the "Organizer"), including virtual and hybrid events.

1. Tickets

A separate ticket is required for each event; prices and details are shown on the ticket page. Tickets are non-refundable unless the event is cancelled or rescheduled by the Organizer, in which case participants are offered a refund or transfer to the rescheduled date. Refunds are processed within 14 days and may be subject to a processing fee disclosed at purchase, to the extent permitted by consumer law.

2. Age

Participants must be at least 16 years old; minors require parental consent.

3. Photography and filming

Events may be photographed or filmed for promotional use. Participants who do not wish to be recorded must notify live@musictraveler.com at least 48 hours before the event or use an opt-out badge provided at registration where available.

4. Data and newsletter

Personal data is handled under our Privacy Policy. With your consent, your email may be used for our newsletter; you can unsubscribe at any time. Contest or casting submissions are used for evaluation and, with your consent, promotion.

5. Liability

The Organizer is not liable for personal injury or property damage except in cases of gross negligence or wilful misconduct, or where liability cannot be excluded by law; otherwise liability is limited to the ticket price. The Organizer is not liable for cancellations caused by events beyond its reasonable control.

6. Governing law

Austrian law applies; Vienna is the place of jurisdiction for non-consumer disputes, without prejudice to mandatory consumer protections.
